I have read and understood the PDS and agree to be bound by the terms and conditions of that document, and any other relevant terms and conditions (as amended from time to time) that apply to my entire relationship with BTX and the RE;

I have the power and am duly authorised to invest and hold interests in the Scheme;

I have received the PDS from the internet or by other electronic means in Australia and declare that I have received it personally, before making an application for interests in the Scheme;

I agree to be bound by the terms and conditions set out in the Constitution of the Scheme;

I agree to the following:

• I consent to all distributions or monies payable to me in connection with my investment in the Scheme being placed in a separate distributions account maintained by the RE or deposited in my nominated bank account, as determined by the RE in its absolute discretion.

• I acknowledge that a Target Market Determination (TMD) for the financial product that I am applying for is available on BTX’s website and the RE’s website.

• I acknowledge that I am not buying a racehorse directly, but rather am investing in a managed investment scheme.
• I understand that my investment in the Scheme may have a fixed expiry date.

• I acknowledge that I do not have a right to withdraw my investment in the Scheme during the term of my investment.
• I acknowledge that an investment in the Scheme is speculative and accept that I should not invest all of my savings in a single investment, such as the Scheme, and that this investment should form part of a broader investment portfolio.

• I accept the risks associated with an investment in the Scheme set out in the PDS, including the risk that the racehorse may die, suffer injury or become ill, resulting in the horse being unable to earn any prizemoney or may be unable to be sold, meaning that I may lose all of the money invested in the Scheme.

• Neither BTX, the RE, nor any of their associates, or their respective directors, officers, agents, advisers or employees guarantees the repayment of capital or the performance of the Scheme or any particular rate of return from the Scheme;
• An investment in the Scheme is subject to risks including possible delays in repayment and possible loss of capital invested;

BTX and the RE reserve the right not to accept any application in their absolute discretion; and

If my application monies are not paid or are dishonoured, BTX will not process my application and will notify me.

I agree to the collection, use and disclosure of my personal information provided in this Application as described in the PDS;

I agree to provide any extra information required in order to complete checks as required by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth);

I declare that any monies used to invest in the PDS are not derived from or related to any criminal activities and that any proceeds from my investment will not be used in relation to any criminal activities;

I am not commonly known by any other names different to those disclosed in this Application;

I declare that all information provided in this Application, including my AML, FATCA and CRS status, and all verification documents provided by me are true and correct and may be relied upon by BTX and the RE;

I agree that if there are any changes to any of the information in this Application or attached verification documents, including my AML, FATCA or CRS status, I will promptly notify BTX and provide any information necessary for BTX and the RE to comply with their AML, FATCA and CRS obligations;

I authorise BTX to complete or amend this Application where necessary to correct any errors or omissions.
